DISTANCE SALES AGREEMENT

This Agreement sets out the terms and conditions upon which Sparklextools LTD (“Company”, “we”, “us”, or “our”) supplies products to you (“Customer”, “you”) via our website. Please read these terms carefully before submitting your order to us.
1. THE CONTRACT WITH YOU
Order Acceptance: Your order is an offer to buy from us. A legally binding contract is formed only when we send you an email confirming that your order has been accepted and dispatched.
Order Rejection: We reserve the right to cancel or refuse any order if payment authorization fails, fraudulent activity is suspected, there is an error in pricing/description on the website, or if the product is out of stock.
2. PRODUCTS AND PRICING
Descriptions: Images of products on our website are for illustrative purposes only. We make every effort to ensure descriptions and specifications are accurate.
Pricing: Prices are displayed on our website and are subject to change without prior notice. If we discover an error in the price of a product you have ordered before dispatch, we will contact you to give you the option of reconfirming the order at the correct price or canceling it.
3. PAYMENT
Payments must be made through our secure, authorized third-party payment gateways. Sparklextools LTD does not directly store or process your complete credit/debit card information. Orders will only be processed once full payment has been cleared.
4. SHIPPING AND DELIVERY
Delivery Times: Delivery timeframes are estimates and may vary depending on the destination country, local customs clearances, courier performance, and events beyond our reasonable control (Force Majeure).
Import Duties & Taxes: For international deliveries outside the United Kingdom, you may be subject to import duties, taxes, and customs clearance fees, which are levied once the package reaches your specified destination. These charges must be borne by you.
5. RIGHT OF CANCELLATION & REFUNDS (UK & EU CONSUMERS)
Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers in the UK (and EU) have the legal right to change their mind and cancel their order.
Cancellation Period: You have 14 days from the day you (or a third party indicated by you) receive the physical products to notify us of your decision to cancel.
Condition of Returns: To qualify for a full refund, items must be returned to us unused, undamaged, and in their original packaging. You are responsible for the direct cost of returning the goods.
Refunds: Once we receive and inspect the returned item, we will process your refund within 14 days. The refund will be issued using the same payment method you used for the original transaction.
6. QUALITY OF GOODS (CONSUMER RIGHTS ACT 2015)
As a UK-based consumer contract, we are under a legal duty to supply products that are in conformity with this contract. Under the Consumer Rights Act 2015, the goods must be:

7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Sparklextools LTD shall not be liable for any indirect, special, incidental, or consequential damages, or loss of profits arising out of or in connection with the purchase of our products. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
8. GOVERNING LAW AND JURISDICTION
This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute.
